The following land in Moody County is offered for sale:
The Northeast Quarter (NE ¼) of Section Thirty-five
(35), Township One Hundred Six (106) North, Range Fifty
(50) West of the 5th P.M., except Out Lot A contained
therein; and including Out Lot B of the Southeast
Quarter (SE ¼) of Section 35, Township 106 North, Range
50 West of the 5th P.M., Moody County, South Dakota.
This land consists of approximately 160 acres and is located
two (2) miles south of Colman on Moody County Highway #3A and
one-half mile east on 237th Street on the south side of the road.
The land is owned by Jennifer L. Lloyd and Wayne A. Lloyd.
TERMS of the sale are as follows: Sealed bids will be accepted
until September 27, 2019, at 9 o’clock a.m.. The successful bidder
must be prepared to sign a purchase agreement and make a
non-refundable earnest money deposit of 10% of the purchase
price upon execution of the purchase agreement. The balance
of the purchase price shall be due and payable at the time of the
closing. Closing will take place on or before December 2, 2019.
This property is being offer for sale “AS IS” as well as any rights,
easements, restrictions and/or reservations of record.
Sellers will obtain a title commitment showing clear and
merchantable title in and to the real estate above described. It shall
be the Buyer’s responsibility to research all information as to his
or her own satisfaction. Each bidder is responsible for conducting
his or her own independent inspections, investigations, and all
due diligence concerning the property. Any potential bidder is
encouraged to investigate the property and review any maps,
zoning information or other information available before bidding.
Compliance of the property for any proposed future use shall be
the responsibility of the Buyer. The sale of the property will not be
contingent upon Buyer obtaining financing.
Sellers shall pay all the prior year’s real estate taxes as well as the
2019 real estate taxes. The title insurance and closing costs shall
be split equally between the parties. The Sellers reserves the right
to reject any and all bids at any time and negotiate the remaining
purchase terms with the successful bidder. The successful bidder
will be notified by mail, email or phone within five (5) days of the
September 27th deadline.
