Notice is hereby given that sealed bids will be accepted on the Shirley Oxner
Estate real estate situated in Walworth County, South Dakota, described as
follows, to-wit:
Lots Three (3) and Four ( 4) and the East Half of the Southwest
Quarter (El/2SW1/4), Section Nineteen (19); and Lots One (1) and
Two (2) and the East Half of the Northwest Quarter (El/2NW1/4) and
the Northeast Quarter (NEl/4), Section Thirty (30), all in Township
One Hundred Twenty-two (122) North, Range Seventy-six (76) West
of the Fifth Principal Meridian, Walworth County, South Dakota.
(Approximately 402 acres of pasture/grass. Approximately 89.34
acres is tillable.)
Possession shall be given to buyer on March 21, 2019. Information and bid forms may
be obtained by contacting Von Wald Law Office, LLC, at P.O. Box 155, Selby, SD 57472,
Telephone No. 605-649-7603. The sealed bids shall be submitted to Von Wald Law
Office, LLC, no later than 11 :00 a.m. CST Wednesday, February 20, 2019. The top three
bidders will be invited to attend an oral auction to be held on Thursday, February 21, 2019,
commencing at 10:00 a.m. CST at Von Wald Law Office, LLC in Selby, South Dakota. If
you are one of the top three bidders and cannot be personally present for the oral auction
on Thursday, February 21, 2019, please contact John Von Wald at 605-649-7603 so as
to make appropriate arrangements. At the oral auction, the top bidder will be required
to deposit 10% of the purchase price with the balance to be paid in cash on or before
March 21, 2019. Sellers will pay all 2018 real estate taxes due and payable in 2019 and
all prior years. Approximately 351.86 acres are enrolled in grassland CRP with an annual
payment of $9,148.36. This CRP contract expires on September 30, 2031. Approximately
89.34 acres are enrolled in CRP with an annual payment of $9,806.00. This CRP contract
expires on September 30, 2030. Seller will retain 2018 CRP payments and assign all 2019
and subsequent payments to buyer. Buyer shall assume said CRP contracts. The cost of
an owner’s policy of title insurance will be split 50/50 between seller and buyer. Von Wald
Law Office, LLC of Selby will be handling the closing and represents the sellers herein. The
sellers reserve the right to accept or reject any and all bids. Balance of purchase price shall
be paid via wire transfer to Von Wald Law Office, LLC Trust Account.
