The Second Amendment states: “A well regulated militia being necessary to the security of a free state, the right of the people to keep and bear arms shall not be infringed.”

But what about the right given to all of us by the Declaration of Independence which states; all men have certain unalienable rights, that among these are life, liberty and the pursuit of happiness. How much life, liberty and happiness were destroyed in Newtown, Conn.? How much life, liberty and happiness are destroyed for the 86 persons who are killed by guns every day on average in this country (statistics from the Center for Disease Control).

A universal background check will not affect any law-abiding citizen, but it will prevent some guns from falling into the wrong hands. For those who are unaware of our laws, the following persons are prohibited from possessing guns:

Persons under indictment for, or convicted of, any crime punishable by imprisonment for a term exceeding on year. Fugitives from justice. Persons who are unlawful users of, or addicted to, any controlled substance. Persons who have been declared by a court as mental defectives or have been committed to a mental institution. Illegal aliens, or aliens who were admitted to the United States under a nonimmigrant visa. Persons who have been dishonorably discharged from the Armed Forces. Persons who have renounced their U.S. citizenship. Persons subject to certain types of restraining orders. Persons who have been convicted of a misdemeanor crime of domestic violence.

Our government needs to take steps from the local government level to the federal government level to ensure that all persons in the listed categories are not allowed to purchase guns. If a gun owner allows anyone on the above list to possess a gun, that gun owner is not a responsible gun owner.
